A CHARTER ORDINANCE EXEMPTING THE CITY OF MCLOUTH, KANSAS FROM PROVISIONS OF K.S.A. 12-4112 RELATING TO THE ASSESSMENT OF COSTS IN MUNICIPAL COURT, AND REPEALING CHARTER ORDINANCE 2010-31.
WHEREAS, the City of McLouth, Kansas, by authority vested pursuant to Article 12, section 5 of the Constitution of the State of Kansas, may enact a Charter Ordinance which provides substitute or additional provisions on the same subject contained in the statute found in the Kansas Statutes Annotated that does not apply uniformly to all cities in Kansas; and
WHEREAS, K.S.A. 12-4101 et seq. is non-uniform in that the provisions do not apply uniformly to all cities;
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MCLOUTH, KANSAS:
Section 1. The portion of K.S.A. 12-4101 et seq., Code for Municipal Courts; General Provisions, in particular K.S.A. 12-4112 regarding costs assessed in municipal courts shall not apply to the City of McLouth.
Section 2. Costs assessed in the Municipal Court of McLouth, Kansas shall be in the amount of $85.00 Traffic Offenses, $100.00 for DUI/Misdemeanor Offenses.
Section 3. Costs assessed in the Municipal Court of McLouth, KS shall include assessments provided for in K.S.A. 12-4117.
Section 4. The Charter Ordinance shall be published in the official City newspaper once a week for 2 consecutive weeks.
Section 5. The Charter Ordinance shall take effect sixty-one (61) days after its final publication unless a sufficient petition for referendum is filed and a referendum held on this ordinance as provided in Article 12, Section 5, Subsection (c)(3) of the Constitution of the State of Kansas, in which case the ordinance shall become effective if approved by the majority of the electors voting thereon.
Section 6. Charter Ordinance 2010-31 is hereby repealed.
